in respect of the Vehicle Lease Agreement

الأحكام والشروط العامة

المتعلقة باتفاقية إيجار المركبة

These General Terms and Conditions are an integral part of the Vehicle Lease Agreement executed between the Customer and OCTANE in respect of the hire and/or lease of the Vehicle. These terms and conditions are fully incorporated into the Agreement by reference therein and are supplemental to the terms set out in the Agreement

تعد هذه الأحكام والشروط العامة جزءاً لا يتجزأ من اتفاقية تأجير المركبة المبرمة بين العميل وأوكتان فيما يتعلق بإيجار المركبة. وقد أدرجت هذه الأحكام والشروط بالكامل في الاتفاقية بالإشارة إليها، وهي مكملة للشروط الواردة في الاتفاقية.

1. Definitions

1- التعاريف

1.1 In this General Terms and Conditions, the following words and expressions shall, unless the context requires otherwise, have the following meanings:

1.1 في هذه الأحكام والشروط العامة، يجب أن تكون للكلمات والعبارات التالية، إن لم يشترط السياق خلاف ذلك، المعاني التالية:

Agreement means the agreement executed between the Customer and OCTANE (Vehicle Lease Agreement) including these T&Cs, and the Chart stipulated on the Website as amended from time to time.

الاتفاقية وتعني الاتفاقية المبرمة بين العميل واوكتان (اتفاقية تأجير المركبة)، بما في ذلك هذه الشروط والأحكام والجدول المنصوص عليه في الموقع الالكتروني لـ اوكتان بصيغته المعدلة من وقت لآخر.

Chart means the chart containing the fees of the Vehicle lease stipulated on the Website at https://octane.rent/prices/.

الجدول وتعني الجدول الذي يحتوي على رسوم إيجار المركبة والمنصوص عليه في موقع اوكتان الالكتروني: https://octane.rent/prices/.

Additional Drivers means any additional drivers nominated by the Customer in the Agreement.

السائقون الإضافيين وتعني أي سائقين إضافيين يعينهم العميل في الاتفاقية.

Customer means the customer who has entered into the Agreement with OCTANE for hiring the Vehicle.

العميل تعني العميل الذي أبرم الاتفاق مع اوكتان لاستئجار المركبة.

Driving License means a valid driver’s license issued by the respective traffic or any other governmental authority, authorizing its holder to driver a vehicle or motor car as specified below.

رخصة القيادة وتعني رخصة قيادة سارية المفعول الصادرة من قبل دائرة المرور المعنية أو أي سلطة حكومية أخرى، تخول حاملها قيادة المركبة كما موضح ادناه.

Lease Period means the lease date as noted in the Agreement and the estimated/confirmed return date of the Vehicle by the Customer to Octane. For clarity, any extension of the Lease Period at the time of or after the expiry of initial or subsequent Lease Period(s) shall be deemed as a new Lease Period.

فترة الإيجار تعني تاريخ الإيجار كما هو مذكور في الاتفاقية، وتاريخ الإرجاع المقدر/المؤكد للمركبة من جانب العميل إلى أوكتان، للتوضيح، أي تمديد لفترة الإيجار في وقت الإيجار أو بعد انتهاء فترة الإيجار الأولية أو اللاحقة، تعتبر فترة إيجار جديدة.

Per Day for the purpose of per day rental, per day means twenty-four (24) hours.

اليوم الواحد لغرض تأجير يوم الواحد ، يعني “اليوم الواحد” أربعة وعشرين (24) ساعة.

رسوم اليوم الواحد تعني رسوم تأجير اليوم الواحد للمركبة كما هو مذكور في الاتفاقية.

Per Day Charge means the Per Day rental charge of the Vehicle as noted in the Agreement.

رسوم اليوم الواحد تعني رسوم تأجير اليوم الواحد للمركبة كما هو مذكور في الاتفاقية.

Permitted Mileage means the Per Day permitted mileage as agreed and noted on the first page of the Agreement and under clause 6.3 of this T&C.

لمسافة المسموح بها تعني المسافة المسموح بها لكل يوم، وذلك وفقًا لما تم الاتفاق عليه وتوثيقه في الصفحة الأولى من العقد ووفقًا للبند 6.3 من هذه الشروط والأحكام.

Restricted Use means, other than reasonable road use, any activities and usage of the Vehicle, including but not limited to driving under the influence of drugs and/or alcohol, racing, rallying, drifting, off-road driving or driving on an un-metaled road, driving through and parking the vehicle in standing water, towing of other vehicles or materials, etc.

لأنشطة / الاستخدامات المحظورة وتعني بخلاف الاستخدام المعقول للطريق وأي أنشطة أو استخدام للمركبة بما في ذلك على سبيل المثال لا الحصر، القيادة تحت تأثير المواد المخدرة او المشروبات الكحولية أو السباق أو الرالي أو (التفحيط) أو القيادة على الطرق الوعرة أو القيادة على طريق غير معبدة أو قيادة المركبة وإيقافها في المياه الراكدة، وسحب المركبات أو مواد أخرى وما إلى ذلك.

T&Cs means these Standard Terms and Conditions of the Agreement.

الشروط والأحكام وتعني هذه الشروط والأحكام العامة الأساسية للاتفاقية.

UAE means the United Arab Emirates.

الإمارات العربية المتحدة وتعني دولة الإمارات العربية المتحدة.

Valid Driving License a Driving License to be valid, for the purpose of this Agreement, it shall meet any of the following conditions:

رخصة القيادة سارية المفعول وحتى تكون رخصة القيادة سارية المفعول، ولغرض هذه الاتفاقية، لا بدّ من أن تستوفى أياً من الشروط التالية:

a.For the UAE nationals, a Driving License, issued by the relevant traffic authorities in the UAE;

b.For the UAE residents (including those with the resident visa under process), a Driving License shall be at least three years old. If it is less than three years old, then a supporting Driving License from any other country proving that its holder has been driving for more than three years;

c.For Chinese nationals, a Driving License in any other language (including Chinese), shall be accompanied by its notarized English translation;

d.A Driving License issued from any of the following countries:

(i)North America: Canada and United States of America;

(ii)East Asia & Pacific: Australia, China, Hong Kong, Japan, New Zealand, Singapore and South Korea;

(iii)Europe: Albania, Austria, Belgium, Bulgaria, Cyprus, Denmark, Finland, Estonia, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Spain, Sweden, Switzerland, Turkey and United Kingdom;

(iv)GCC: Bahrain, Kuwait, Oman, Saudi Arabia and Qatar; and

(v)Africa: South Africa;

أخصة قيادة صادرة عن سلطات المرور المختصة في الدولة لمواطني دولة الإمارات العربية المتحدة.

بالنسبة للمقيمين في دولة الإمارات العربية المتحدة (بما في ذلك أولئك الذين لديهم تأشيرة إقامة قيد الإعداد)، يجب ألا يقل عمر رخصة القيادة عن ثلاث سنوات. وإذا كان عمرها أقل من ثلاث سنوات، فإن رخصة قيادة داعمة من أي دولة أخرى تثبت أن حاملها كان يقود السيارة لأكثر من ثلاث سنوات؛

تالنسبة للمواطنين الصينيين، يجب أن تكون رخصة القيادة بأي لغة أخرى (بما في ذلك الصينية) مصحوبة بترجمتها الإنجليزية الموثقة؛

ثخصة قيادة صادرة من أي من البلدان التالية:

(i)مريكا الشمالية: كندا والولايات المتحدة الأمريكية؛

(ii)رق آسيا والمحيط الهادئ: أستراليا، والصين، وهونغ كونغ، واليابان، ونيوزيلندا، وسنغافورة وكوريا الجنوبية؛

(iii)أوروبا: ألبانيا، والنمسا، وبلجيكا، وبلغاريا، وقبرص، والدنمارك، وفنلندا، وإستونيا، وفرنسا، وألمانيا، واليونان، والمجر، وأيسلندا، وأيرلندا، وإيطاليا، ولاتفيا، وليتوانيا، ولوكسمبورغ، ومالطا، والجبل الأسود، وهولندا، والنرويج، وبولندا، والبرتغال، ورومانيا، وصربيا، وسلوفاكيا، وإسبانيا، والسويد، وسويسرا، وتركيا والمملكة المتحدة؛

(iv)مجلس التعاون الخليجي: البحرين، والكويت، وعُمان، والمملكة العربية السعودية وقطر؛

(v)فريقيا: جنوب أفريقيا؛

e. Drivers from the countries not listed above are only permitted to drive with a valid international Driving License supported by the original home country Driving License provided they are not residents of the UAE under an employment or other type of resident visa.

ولا يسمح للسائقين القادمين من البلدان غير المذكورة أعلاه بقيادة المركبات إلا برخصة قيادة دولية سارية المفعول مدعمة برخصة قيادة البلد الأصلي شريطة ألا يكونوا مقيمين في الإمارات العربية المتحدة بموجب عمل أو أي نوع آخر من تأشيرات الإقامة.

In addition to the above, a Driving License meeting any of the above conditions shall be accompanied by a valid passport as an additional proof of identification. However, the UAE nationals and residents can provide a copy of their Emirates ID.

بالإضافة إلى ما تقدم، يجب أن تكون رخصة القيادة التي تستوفي أيًا من الشروط المذكورة أعلاه مصحوبة بجواز سفر ساري المفعول كدليل إضافي لإثبات الشخص. ومع ذلك، يمكن لمواطني دولة الإمارات والمقيمين فيها تقديم نسخة عن الهوية الإماراتية الخاصة بهم.

Vehicle means the vehicle of OCTANE that the Customer has agreed to lease or hire in accordance with the terms of this Agreement, the details of which including its brand and type, traffic plate number, engine number, year of manufacture among others are set out in the Agreement.
Website means OCTANE’s website from time to time, currently https://octane.rent

المركبة ويقصد بها مركبة أوكتان، التي وافق العميل على استئجارها وفقًا لشروط هذه الاتفاقية، والتي حددت تفاصيلها في هذه الاتفاقية، بما في ذلك فئتها ونوعها ورقم لوحة المرور ورقم المحرك وسنة الصنع وغيرها. الموقع الإلكتروني يعني موقع أوكتين من حين لآخر، حاليًا https://octane.rent

1.2 unless the context otherwise requires:

(a) words in the singular shall include the plural and vice-versa;

(b) words in the masculine shall include the feminine; and

(c) words relating to natural persons shall include companies, entities, associations or bodies of persons whether incorporated or not.

1.3 the word “may” shall be construed as permissive and the word “shall” as imperative.

1.4 A reference in this Agreement to a document is a reference to the document whether in paper or electronic form.

1.5 Unless the context otherwise requires, words in the singular shall include the plural and, in the plural, shall include the singular.

1.6 Unless the context otherwise requires, a reference to one gender shall include a reference to the other genders.

1.7 Any obligation on a person not to act or do something includes an obligation not to allow that thing to be done by others.

1.8 All dates and periods of time referred to in this Agreement shall be ascertained in accordance with the Gregorian calendar.

1.9 Unless the context requires otherwise, reference to a “Emirati Dirham” or “AED” are references to Emirati Dirhams, legal currency of the United Arab Emirates.

1.10 The words “include”, “includes” and “including” shall be construed as if the phrase “without limitation” was added.

1.2- ا لم يقتض السياق خلاف ذلك:

أ‌ جب أن تشمل الكلمات بصيغة المفرد الجمع والعكس صحيح؛

ب‌ شمل الكلمات في المذكر المؤنث؛

ت‌ تشمل الكلمات المتعلقة بالأشخاص الطبيعيين الشركات أو الكيانات أو الجمعيات أو هيئات الأشخاص سواء كانت مؤسسة أم لا.

1.3- جب تفسير كلمة “يجوز” على أنها مسموح بها وكلمة “يجب” على أنها ضرورة.

1.4- إن الإشارة في هذه الاتفاقية إلى وثيقة هي إشارة إلى الوثيقة سواء أكانت ورقية أم إلكترونية.

1.5- ا لم يقتضِ السياق خلاف ذلك، يجب أن تتضمن الكلمات بصيغة المفرد الجمع وفي الجمع يجب أن تتضمن المفرد.

1.6- ا لم يقتضِ السياق خلاف ذلك، يجب أن تتضمن الإشارة إلى أحد الجنسين إشارة إلى الجنس الآخر.

1.7- ي التزام على الشخص بعدم التصرف أو القيام بشيء ما يتضمن التزامًا بعدم السماح للآخرين بفعل هذا الشيء.

1.8- جب التأكد من جميع التواريخ والفترات الزمنية المشار إليها في هذه الاتفاقية وفقًا للتقويم الميلادي.

1.9- ا لم يقتض السياق خلاف ذلك، فإن الإشارة إلى ” الدرهم الإماراتي ” أو ” د. إ” هي إشارات إلى الدرهم الإماراتي، وهي العملة القانونية لدولة الإمارات العربية المتحدة.

1.10- فسر الكلمات “تشمل” و “بما في ذلك” كما لو أضيفت عبارة “على سبيل المثال لا الحصر” إليهم.

2. Eligibility, required documents and Chart

الأهلية والوثائق المطلوبةو الجدول

2.1 Customer hereby represents and warrants that he/she (including the Additional Drivers, if any) have a Valid Driving License and shall maintain its validity during the Lease Period.

2.2 The Customer hereby undertakes that it shall in the event of expiry and/or invalidation of his/her and Additional Drivers’ (if any) Driving License shall immediately notify OCTANE and stop using the Vehicle with immediate effect.

2.3 The Customer confirms that he does not have an Emirates ID or, if he does, that he has a valid Emirates driver’s license (“UAE DL”).
a.The Customer hereby acknowledges and agrees that he was warned that Octane’s policy prohibits renting a vehicle to a person who has an Emirates ID unless that person also has a valid UAE DL (“Rent without UAE DL”).
b.In case of a Rent without UAE DL by the Customer, the Customer certifies that he is aware that:

• Any insurance coverage and the Octane Shield renders are ineffective and invalid.
• The Customer assumes full lability and responsibility, including but not limited to any financial liability, for any and all claims, demands, complaints, liabilities, losses, damages, costs and expenses (“Damages”) arising from, relating to or in connection with the Rent without UAE DL.

The Customer hereby releases Octane and each of its employees, shareholders and directors (collectively, the “Indemnitees”), and the Customer hereby agrees to indemnify, defend and hold harmless the Indemnitees, from and against any and all Damages.

2.1- قر العميل ويضمن بموجبه أنه (بما في ذلك السائقين الإضافيين، إن وجدوا) لديهم رخصة قيادة سارية المفعول ولا بدّ من أن يحافظوا على صلاحيتها خلال فترة الإيجار.

2.2- تعهد العميل بموجبه أنه في حالة انتهاء الصلاحية و/ أو إبطال رخصة القيادة الخاصة به / بها ورخصة السائقين الإضافيين (إن وجدت) يجب على الفور إخطار أوكتان والتوقف عن استخدام المركبة بأثر فوري.

2.3- يؤكد العميل أنه لا يمتلك بطاقة الهوية الإماراتية، أو إذا كان لديها، فإنه لديه رخصة قيادة إماراتية صالحة (“رخصة قيادة الإمارات”).
– يقر العميل هنا بأنه تم تحذيره وأنه يوافق على أن سياسة أوكتين تمنع تأجير مركبة لشخص يمتلك بطاقة هوية إماراتية ما لم يكن لديه أيضًا رخصة قيادة إماراتية صالحة (“الإيجار بدون رخصة قيادة الإمارات”).
– في حالة الإيجار بدون رخصة قيادة الإماراتية من قبل العميل، يشهد العميل بأنه على علم بأن:
أي تغطية تأمينيه ومزايا درع أوكتين تصبح غير فعالة وباطلة.
يتحمل العميل مسؤولية كاملة، بما في ذلك ولكن لا تقتصر على أي مسؤولية مالية، عن أي وجميع المطالبات والمطالب والشكاوى والمسؤوليات والخسائر والأضرار والتكاليف والنفقات (“الأضرار”) الناشئة عن أو المتعلقة أو في اتصال مع الإيجار بدون رخصة قيادة الإماراتية.
العميل يطلق هنا سراح شركة أوكتين وكل من موظفيها ومساهميها ومديريها (بشكل مجمع، “المحمين”)، ويوافق العميل هنا على تعويض والدفاع عن المحمين، وحمايتهم من أي وجميع الأضرار.

The Chart

الجدول

2.4 The customer acknowledges that he has read and will abide by the schedule stipulated in OCTANE website (https://octane.rent), which is an integral part of the agreement and is read with it.

2.5 2.5 Without prejudice to (4.5) below, any extension not agreed upon with OCTANE is considered a new lease period for the vehicle, according to what is stipulated in the schedule.

2.6 Along with any other restrictions stipulated in the Chart the Customer undertakes to abide/comply with the age restrictions as mentioned in the Vehicle Lease Agreement.

2.4- يقر العميل بأنه قد قرأ و يلتزم بـ الجدول المنصوص عليه في الموقع الالكتروني لـ أوكتان (https://octane.rent) والذي يعتبر جزأ لا يتجزأ من هذه الاتفاقية ويقرأ معها.

2.5- بما لا يتعارض مع البند (4.5) ادناه، يعتبر أي تمديد غير متفق عليه مع أوكتان بمثابة إيجار جديد للمركبة وذلك وفقا لما نص عليه الجدول.

2.6- بالإضافة إلى أي قيود أخرى محددة في الجدول، يلتزم العميل بالامتثال لقيود العمر كما هو مذكور في اتفاقية تأجير المركبة.

NOTE: any of the charges reflecting in the above Tariff may at any time be changed or increased by OCTANE in its absolute discretion.

لاحظة: أي من الرسوم الواردة في الجدول المذكورة آعلاه يمكن تغييرها أو زيادتها في أي وقت من قبل اوكتان وفقًا لتقديرها المطلق.

3. Delivery Policy

3- سياسة التسليم

3.1    The Customer acknowledges that the delivery date and time of the Vehicle shall at all times be pre-agreed between the Customer and OCTANE.
3.2    The Vehicle, if requested, may be delivered to the Customer outside the normal working days and hours, subject to respective locations at an additional charge. The Customer shall contact the OCTANE representative if the Vehicle is required outside the normal working hours and day and agree on the relevant extra charge which must be paid at the time of accepting the delivery of the Vehicle or in advance, if so required by the OCTANE representative.
3.3    By accepting the Vehicle upon its delivery, the Customer accepts that the Vehicle is in the condition as noted in the Agreement and the Customer shall accordingly ensure that the same condition is maintained until the return of the Vehicle to OCTANE at which time the Vehicle will be inspected by the OCTANE’s representative before accepting its return.

3.1- يقر العميل بأن تاريخ تسليم المركبة ووقته يجب أن يتم الاتفاق عليه مسبقًا في جميع الأوقات بين العميل وأوكتان.

3.2- من الجائز تسليم المركبة إلى العميل خارج أيام وساعات العمل المتعارف عليها إذا طلب العميل ذلك، وذلك وفقًا للمواقع المخصصة، مقابل رسوم إضافية. ويجب على العميل الاتصال بممثل اوكتان إذا كانت المركبة مطلوبة خارج أيام وساعات العمل المتعارف عليها، ويتفق على الرسوم الإضافية ذات الصلة التي يجب دفعها وقت قبول تسليم المركبة أو مقدمًا، إذا طلب ممثل أوكتان ذلك.

3.3- ي حال قبول العميل للمركبة عند تسليمها إليه، فإنه يوافق على أن المركبة في الحالة المشار إليها في الاتفاقية. وعليه، يجب على العميل وفقًا لذلك ضمان الحفاظ على نفس حالة المركبة حتى موعد تسليمها إلى اوكتان. وعندئذ يتم فحص المركبة من قبل ممثل اوكتان قبل الموافقة على ارجاعها.

4. Lease Period, Return Policy and Extension

4. فترة الإيجار وسياسة الإرجاع والتمديد

4.1 Per Day Charges for the Vehicle are on a twenty-four (24) hour basis;

4.1- الرسوم اليومية للسيارة هي على أساس أربع وعشرين (24) ساعة

4.2 OCTANE grants a grace period of 30 minutes for renting a car. Thereafter, in addition to any additional rental days, the Customer will be charged the following Late Return Fine:

• AED 300 for a delay of 31 to 120 minutes

• Daily rental rate for more than 120 minutes of delay

The Customer may avail an option of the Vehicle late return, for one (1) to four (4) hours, with an additional prepaid fee. This option eliminates any grace period and incurs Late Return Fines. A written request shall be sent by the Customer to OCTANE no later than three (3) hours before the end of the Lease Period. Such a request is subject to the acceptance and refusal of OCTANE at its own discretion.

4.2- تمنح أوكتان فترة سماح تبلغ 30 دقيقة لإيجار السيارة. بعد هذه الفترة، وبالإضافة إلى أي أيام إيجار إضافية، سيتم محاسبة العميل على رسوم التأخير على النحو التالي

• 300 درهماً إماراتياً للتأخير من 31 إلى 120 دقيقة

• معدل الإيجار اليومي لأكثر من 120 دقيقة تأخير

يمكن للعميل الاستفادة من خيار إرجاع المركبة متأخرًا لمدة تتراوح من ساعة (1) إلى أربع (4) ساعات ، مع دفع رسوم إضافية مدفوعة مسبقًا. يُلغي هذا الخيار أي فترة سماح ويتحمل العميل غرامات التأخير في الإرجاع. يجب أن يُرسل الطلب الكتابي من العميل إلى أوكتان قبل نهاية فترة الإيجار بثلاث ساعات (3) على الأقل. يخضع مثل هذا الطلب لقبول أو رفض أوكتان بتقديرها الخاص

4.3 In case of reduction of the Lease Period by a day or more at the request of the Customer, the agreed Per Day Charge will be recalculated in accordance with the applicable current tariffs for that particular lease period and any residue of the previously paid rental amount will be returned to the Customer after deduction of early termination charge of AED 500;

4.3 في حال تقليص فترة الإيجار ليوم أو أكثر بناءً على طلب العميل، سيتم إعادة حساب الرسوم اليومية المتفق عليها وفقًا للتعريفات الحالية المطبقة على فترة الإيجار تلك، وسيتم إرجاع أي مبلغ متبقي من الإيجار المدفوع مسبقًا للعميل بعد خصم رسوم الإنهاء المبكر بقيمة 500 درهم.

4.4 It may be noted that any return outside the normal working hours and/or at locations not pre-agreed with OCTANE may be subject to additional charges, determined in the sole discretion of OCTANE. The Customer shall confirm such additional charges beforehand with the relevant OCTANE representative failing which the Customer shall be obliged to pay any such cost as levied by OCTANE should the Customer wish to return the Vehicle outside the normal business hours as noted in clause ‎3.2 above and at any location which is not pre-agreed location of return of the Vehicle.

4.4- وتجدر الإشارة إلى أن أي عملية إرجاع تجرى خارج ساعات العمل المتعارف عليها و / أو في مواقع لم يتم الاتفاق عليها مسبقًا مع أوكتان قد تخضع لرسوم إضافية، وتحدد هذه الرسوم حصريًا وفقًا لتقدير أوكتان. ويجب على العميل تأكيد هذه الرسوم الإضافية مسبقًا مع ممثل أوكتان ذي الصلة، وإلا يلزم العميل بدفع أي تكلفة تفرضها أوكتان إذا رغب في إعادة السيارة خارج ساعات العمل المتعارف عليها وكما هو مذكور في البند 3.2 أعلاه، وفي أي موقع غير متفق عليه مسبقًا لإعادة المركبة.

4.5 If the Customer wishes to extend the term of this Agreement prior to the expiry date of its term, a written request shall be sent by Customer to OCTANE at its customer service WhatsApp number +971 52 726 9337 or at info@octane.rent from the Email of the Customer stated in the Agreement. Such a request is subject to the acceptance and refusal of OCTANE at its own discretion. Hence the Agreement may not be extended unless OCTANE’s written confirmation is granted, and the Per Day Charge/s have been paid. The Customer shall state in the extension request the number and date of the agreement, his/her full name and the required extension period, according to the following example:
“With reference to the Vehicle Lease Agreement number {insert agreement number} dated {insert agreement date} (the “Agreement”), I {insert full name} would like to extend the term of the Agreement for {insert number of days/months} till {insert return date} in accordance with clause (8) of the Agreement”.

4.5- في حالة رغبة العميل تمديد مدة هذه الاتفاقية، قبل تاريخ انتهاء مدتها ، يجب إرسال طلب كتابي من قبل العميل إلى أوكتان على رقم واتساب خدمة العملاء +971 52 726 9337 او على info@octane.rent من البريد الإلكتروني للعميل الوارد في الاتفاقية. يخضع هذا الطلب لقبول ورفض أوكتان وفقًا لتقديرها الخاص. وبالتالي، لا يجوز تمديد مدة هذه الاتفاقية إن لم يتم الحصول على تأكيد كتابي من أوكتان ودفع الرسوم اليومية..
يجب على العميل إرسال طلب التمديد مذكورا فيه رقم الاتفاقية وتاريخها، الاسم، مدة التمديد المطلوبة وذلك حسب المثال التالي: “بالإشارة إلى اتفاقية تأجير السيارة رقم {ادخل رقم الاتفاقية} المؤرخة بــ {ادخل تاريخ الاتفاقية} (“الاتفاقية”)، أود انا {ادخل الاسم الكامل} تمديد مدة الاتفاقية لـ {ادخل عدد الأيام / الشهر} حتى {ادخل تاريخ الإرجاع} وفقًا للبند (8) من الاتفاقية “.

4.6 OCTANE may require the Customer to replace the Vehicle at any time during the business hour of a working day if the Vehicle is due for any service, maintenance, sale exchange or any other purpose as deemed appropriate by OCTANE. In such event the Customer shall cooperate with OCTANE and return the Vehicle by accepting a replacement vehicle from OCTANE (a replacement vehicle may be temporary until OCTANE arranges for the Vehicle of same model and type as the one that has been replaced.

4.6- جوز لاوكتان الطلب من العميل استبدال المركبة في أي وقت خلال ساعات العمل وأي يوم من أيام العمل إذا كانت السيارة بحاجة لأي خدمة أو صيانة أو تبديل او بيع أو أي غرض آخر حسبما تراه اوكتان مناسبًا. وفي مثل هذه الحالة، يجب على العميل التعاون مع اوكتان وإعادة المركبة والقبول بمركبة بديلة. وتكون هذه المركبة البديلة مؤقتة حتى تستطيع أوكتان توفير مركبة من نفس الطراز والنوع للمركبة التي تم استبدالها.

4.7 OCTANE reserves the right to recall and repossess the Vehicle at any time if the Customer has violated any of the terms of the Agreement and/or T&Cs.

4.7- تحتفظ أوكتان بالحق في طلب إعادة المركبة واستعادتها في أي وقت إذا كان العميل قد انتهك أيًا من شروط الاتفاقية و/أو الشروط والأحكام.

4.8 In the event the Customer does not return the Vehicle on the agreed return date or does not pay the fees or otherwise violates terms of this Agreement and is not responding to OCTANE’s request for return of the Vehicle, OCTANE may:

4.8- في حالة عدم قيام العميل بإعادة المركبة في تاريخ الإرجاع المتفق عليه، أو عدم قيامه بسداد مدفوعات الرسوم اليومية أو انتهاك شروط هذه الاتفاقية بطريقة أخرى أو عدم الاستجابة لطلب أوكتان لإعادة السيارة، يجوز لأوكتان:

(a) Report the Vehicle to police as stolen;

(b) Take all legal action permitted by law, including but not limited to, filing claims/cases against the Customer for damages, non-payment and outstanding dues;

أ‌ إبلاغ الشرطة بسرقة المركبة؛

ب‌ رفع دعوى لدى الشرطة ضد العميل لعدم دفع أي مستحقات معلقة؛

ت‌ استعادة المركبات واستردادها دون أي إخطار أو موافقة من العميل؛

4.9 To inform OCTANE of any kind of traffic or driving fines, tickets or warnings received during the lease period or any extension thereof.

4.9- بلاغ اوكتان بأي نوع من غرامات المرور أو غرامات القيادة أو التذاكر أو التحذيرات المستلمة خلال فترة الإيجار أو أي تمديد لها

4.10 Upon OCTANE’s agent’s request, Customer shall provide the exact location of the Vehicle.

4.10- ناءً على طلب وكيل اوكتان، يجب على العميل تحديد موقع المركبة.

4.11 Upon OCTANE’s request, the Customer shall permit OCTANE’s agent or a third party to inspect the Vehicle.

4.11- ناءً على طلب اوكتان، يجب على العميل السماح لوكيل اوكتان أو لطرف ثالث بفحص المركبة.

5. Booking requirements

5- متطلبات الحجز

5.1 Minimum booking prepayment is AED 500 for Lease Period up to and including 9 days. For rentals of 10 days or more, the minimum booking prepayment is 30% of the total rental price, but not less than AED 500 and not more than AED 5,000.

5.1 الحد الأدنى لمبلغ الحجز المسبق هو 500 درهم إماراتي لفترة إيجار تصل إلى 9 أيام شاملة. بالنسبة للإيجارات التي تبلغ 10 أيام أو أكثر، يكون الحد الأدنى لمبلغ الحجز المسبق 30% من إجمالي سعر الإيجار، ولكن لا يقل عن 500 درهم إماراتي ولا يزيد عن 5000 درهم إماراتي.

5.2 The Customer shall deposit a security deposit in the amount stated in the Chart before receiving the Vehicle (“Deposit”). The Deposit will be refunded to the Customer upon return of the Vehicle at the end of the rental following the set-off and payments under clause 6.6 of this Agreement.

Notwithstanding the foregoing, the Customer may rent the Vehicle without placing the Deposit by signing the No Security Deposit Rental Terms and Conditions (which incorporated herein as a part of this Agreement) and making a non-refundable payment.

5.2- يجب على العميل دفع وديعة تأمين بالمبلغ المُحدد في الجدول قبل استلام السيارة (“الوديعة”). سيتم استرداد الوديعة للعميل عند إرجاع السيارة في نهاية فترة التأجير بعد تسوية الحساب ودفع المبالغ المستحقة وفقًا لبند 6.6 من هذا الاتفاق. بغض النظر عن ما سبق، يمكن للعميل استئجار السيارة دون وضع الوديعة عند توقيع شروط وأحكام استئجار بدون تأمين (والتي يتم إدراجها هنا كجزء من هذا الاتفاق) ودفع مبلغ غير قابل للاسترداد قدره.

5.3 If the Customer cancels the booking within 48 hours after the booking prepayment was paid by the Customer, the full booking prepayment will be refunded to the Customer;

5.3 إذا قام العميل بإلغاء الحجز خلال 48 ساعة بعد دفع مبلغ الحجز المسبق، سيتم رد كامل مبلغ الحجز المسبق إلى العميل ؛

5.4 If the Customer cancels the booking 48 Hours or more after the booking prepayment was paid by the Customer, no refund will be provided;

5.4 إذا قام العميل بإلغاء الحجز بعد مرور 48 ساعة أو أكثر من دفع مبلغ الحجز المسبق، لن يتم تقديم أي استرداد ؛

5.5 If the Customer postpones the booking (subject to OCTANE’s prior approval which may be denied in OCTANE’s absolute discretion) or reduces the period of booked rent 72 Hours or less before the start of the booking period, the Customer is liable to pay an additional charge of AED 500;

5.5- وإذا قام العميل بتأجيل الحجز (رهناً بموافقة أوكتان المسبقة التي قد تُرفض وفقا لتقدير أوكتان المطلق) أو خفض فترة الإيجار المحجوزة قبل 72 ساعة أو أقل من بداية فترة الحجز، فإن العميل يكون مسؤولاً عن دفع رسوم إضافية قدرها 500 درهم.

5.6 The Customer must provide original documents upon car delivery (physical documents), such as: Original Driving License, Passport, International driving license (if applicable). If Customer has a residency in UAE, customer must provide: Passport, EID, UAE driving license. Failure to provide mentioned documents will be treated as a cancellation of the rental and will result a penalty charge of AED 500.

5.6- يجب على العميل تقديم المستندات الاصلية عند استلام السيارة. مثل: رخصة السياقة الاصلية، جواز السفر الاصلي، رخصة السياقة الدولية (ان وجدت) في حال وجود اقامة في دولة الامارات العربية المتحدة، يجب على العميل تقديم: جواز السفر الاصلي، الهوية الاماراتية ورخصة سياقة من إصدار دولة الإمارات العربية المتحدة. في حال عدم تقديم المستندات المطلوبة، سيتم إلغاء الحجز وسيتم احتساب غرامة قدرها 500 درهم اماراتي

6. Charges and payments

6- الرسوم والمدفوعات

6.1 All charges including the Per Day Charge are exclusive of VAT and any other taxes which shall be solely borne by the Customer.

6.1- ميع الرسوم بما في ذلك الرسوم اليومية لا تشمل ضريبة القيمة المضافة وأي ضرائب أخرى والتي يتحملها العميل وحده.

6.2 OCTANE will charge Additional driver(s) fee for each Additional Driver listed in the Agreement. The Additional driver(s) fee is as indicated in the Agreement and consists of the Additional driver Base Fee together with the Additional driver Extra Fee for each additional rental day beyond 1 (one) day, including any prolongation of the Lease Period. For clarity, the Customer and any additional drivers shall remain jointly and solely liable for all obligations under the Agreement. If any person other than the Customer or the Additional drivers uses the Vehicle, the Customer is liable to pay an additional charge of AED 500 for each instance of such violation.

6.2- تقوم شركة اوكتين بفرض رسوم السائق الإضافي عن كل سائق إضافي مذكور في هذا الاتفاق. وتكون رسوم السائق الإضافي على النحو المبين في الاتفاق، وتتكون من الرسوم الأساسية للسائق الإضافي مضافًا إليها الرسوم الإضافية للسائق الإضافي عن كل يوم إيجار إضافي بعد اليوم الواحد (1)، بما في ذلك أي تمديد لمدة فترة الإيجار.
للتوضيح، يظل العميل وأي سائقين إضافيين مسؤولين بشكل مشترك ومنفرد عن جميع الالتزامات المنصوص عليها في الاتفاقية. إذا استخدم أي شخص غير العميل أو السائقين الإضافيين السيارة، يتحمل العميل دفع رسم إضافي قدره 500 درهم لكل مرة يتم فيها ارتكاب مثل هذا الانتهاك.

6.3 Any Extra Mileage in excess of the Permitted Mileage shall be charged as agreed and noted on the first page of the Agreement with account for Short-Term and/or Long-Term Lease period as described below.
“Short-Term”: means a Lease Period of up to and including 29 calendar days.
“Long-Term”: means a Lease Period of 30 calendar days or more.
If there two or more consecutive Lease Periods, the Permitted Mileage and Excess Fee are calculated in accordance with the relevant Short-Term Daily Permitted Mileage until the first Long-Term (if any), and by the relevant Long-Term Daily Permitted Mileage from that point onward. If such consecutive Lease Periods include a Long-Term interval, the Excess Charge is charged at the applicable Long-Term Excess Charge, otherwise, the Short-Term Excess Charge applies.

6.3- أي كيلومترات إضافية تتجاوز الحد المسموح به سيتم احتسابها وفق ما هو متفق عليه ومذكور في الصفحة الأولى من العقد، مع الأخذ بعين الاعتبار فترة الإيجار قصيرة الأجل و/أو طويلة الأجل كما هو موضح أدناه:
قصيرة الأجل”: تعني فترة إيجار تصل حتى 29 يومًا تقويميًا (شاملاً).
طويلة الأجل”: تعني فترة إيجار 30 يومًا تقويميًا أو أكثر.
في حال وجود فترتي إيجار متتاليتين أو أكثر، يتم احتساب الحد المسموح به من الكيلومترات والرسوم الإضافية وفقًا للحد اليومي المسموح به للإيجار قصير الأجل حتى بداية أول فترة إيجار طويلة الأجل (إن وجدت)، وبعدها يتم الاحتساب وفق الحد اليومي المسموح به للإيجار طويل الأجل. وإذا تضمنت فترات الإيجار المتتالية فترة طويلة الأجل، يتم تطبيق رسم الكيلومترات الإضافية الخاص بالإيجار طويل الأجل، أما إذا لم تتضمن، فيتم تطبيق رسم الكيلومترات الإضافية الخاص بالإيجار قصير الأجل.

6.4 For each Salik (or any other applicable toll tax) crossing will be charged to the Customer at the current amount. The current charge per Salik is AED 7.5.

6.4- ويحصل المبلغ الفعلي من العميل لكل عبور من معابر سالك (أو أي ضريبة أخرى سارية على رسوم المرور)، وتبلغ الرسوم الحالية لكل عبور من معابر سالك بمبلغ قدره 7.5 دراهم.

6.5 All fines (including but not limited to parking and traffic fines) incurred during the Lease Period of the Vehicle will be the responsibility of the Customer and must be paid at actuals by OCTANE as and when incurred. The Customer shall immediately pay the relevant monies or OCTANE may debit such amount from the Customer’s credit card. Each fine not paid by the Customer directly to relevant authorities of UAE is subject to Octane administrative fee of AED 39.

6.5- جميع الغرامات (بما في ذلك، على سبيل المثال لا الحصر، غرامات المواقف والمخالفات المرورية) التي يتم تكبدها خلال فترة إيجار المركبة ستكون مسؤولية العميل ويجب أن تدفعها أوكتين بالقيمة الفعلية عند استحقاقها. يتعين على العميل دفع المبلغ المستحق فورًا، أو يجوز لـ أوكتين خصم هذا المبلغ من بطاقة الائتمان الخاصة بالعميل. كل غرامة لم يتم دفعها مباشرة من قبل العميل للجهات المختصة في دولة الإمارات العربية المتحدة ستكون خاضعة لرسوم إدارية من أوكتين بقيمة 39 درهمًا إماراتيًا.

6.6 If any traffic fine incurred during the Lease Period results in black points, the Customer will be charged an administrative fee of AED 200 per each such black point.

6.6 اذا تسببت أي مخالفة مرورية خلال فترة الإيجار في تسجيل نقاط سوداء، فسيتم تحميل العميل رسومًا إدارية قدرها 200 درهم إماراتي عن كل نقطة سوداء.

6.7 A Rental Processing Fee shall be applied to each rental. This fee covers booking processing, payment administration, verification of Customer and any Additional Driver documentation, and access to 24/7 customer support during the rental period.

6.7. سيتم تطبيق رسوم معالجة التأجير على كل عملية تأجير. تغطي هذه الرسوم معالجة الحجز، وإدارة المدفوعات، والتحقق من مستندات العميل وأي سائق إضافي، وإتاحة الوصول إلى خدمة دعم العملاء على مدار الساعة طوال أيام الأسبوع (24/7) خلال فترة التأجير.

6.8 To the extent permitted by applicable law, Customer irrevocably and unconditionally authorize OCTANE to use the Deposit to set-off and to pay all payments due under the terms of this Agreement (including but not limited to Vehicle rental fees and any ancillary charges such as traffic fine, traffic fine supporting document, Salik or toll fees, damage, petrol, etc.).

6.8 إلى الحد الذي يسمح به القانون المعمول به ، يأذن العميل بشكل لا رجعة فيه وبشكل لا يشترط بأي شروط بشكل نهائي لـ “أوكتين” باستخدام الوديعة لتسوية ودفع جميع المبالغ المستحقة بموجب أحكام هذا الاتفاق (بما في ذلك ولكن لا يقتصر على رسوم تأجير السيارة وأي رسوم إضافية مثل الغرامات المرورية، وثيقة دعم الغرامات المرورية، سالك أو رسوم التلفيق، الأضرار، البنزين، إلخ.).

6.9 If a Customer pays an amount exceeding the total due for the transaction, the Customer shall have the option to either:
a. Receive a refund of the overpaid amount, or
b. Retain the overpaid amount as a credit balance for subsequent rentals.

6.9 إذا قام العميل بدفع مبلغ يتجاوز المجموع المستحق للمعاملة، يكون للعميل الخيار بين:

a. استلام رد مبلغ الزيادة المدفوعة ، أو

b. الاحتفاظ بالمبلغ المدفوع الزائد كرصيد لعمليات الإيجار التالية.

6.10 If the Customer chooses to maintain the overpaid amount as a credit balance, this balance shall be applied towards the payment for the next rental. If the Customer possesses a prepaid balance and it remains unused for rentals within one (1) year from the date of the conclusion of the last successful rental, the prepaid balance shall be forfeited and become the property of Octane.

6.10 إذا اختار العميل الاحتفاظ بالمبلغ المدفوع الزائد كرصيد، يتم تطبيق هذا الرصيد على دفع الإيجار التالي. إذا كان لدى العميل رصيد مدفوع مسبقًا ولم يتم استخدامه لعمليات الإيجار خلال عام واحد من تاريخ انتهاء آخر عملية إيجار ناجحة، يتم ضياع الرصيد المدفوع مسبقًا ويصبح ملكًا لشركة أوكتان.

7. Geographical Limits

In no event, the Customer shall drive or otherwise take the Vehicle outside the geographical boundaries of the United Arab Emirates. In such an event, the Customer may without prejudice to any other rights of OCTANE under this Agreement and law, be subject to relevant criminal penalties and punishments for the illegal misappropriation of OCTANE’s property.

لا يجوز بأي حال من الأحوال أن يقود العميل المركبة أو يأخذها خارج الحدود الجغرافية لدولة الإمارات العربية المتحدة. ويجوز أن يخضع العميل في مثل هذه الحالة، للعقوبات الجنائية والعقوبات المتعلقة بالاختلاس غير المشروع لممتلكات أوكتان مع عدم المساس بأي حقوق أخرى لأوكتان، وذلك بموجب هذه الاتفاقية والقانون.

7.2 Speeding Violations

7.2 انتهاك حدود السرعة

a. The Customer acknowledges and agrees that in addition to any other terms of this T&Cs, if the Vehicle’s speed exceeds the permitted speed limit at any time during the Rental Period, Octane reserves the right at its sole discretion to immediately immobilize the Vehicle, retrieve the Vehicle from the Customer, and terminate the Agreement without any refund.

b. The Customer further acknowledges and agrees that Octane’s actions outlined in Section 7.2 of this Agreement are necessary due to the increased risk of accidents and safety hazards associated with high-speed driving. The Customer understands and agrees that such behavior is prohibited in the UAE and constitutes a severe traffic violation.

c. The Customer irrevocably and unconditionally waives all rights, claims and demands of any kind against Octane or any of its employees in connection with Octane’s actions referred to in this Section 7.2.

a. يقر العميل ويوافق على أنه بالإضافة إلى أي شروط أخرى في هذه الشروط والأحكام، إذا تجاوزت سرعة المركبة الحد المسموح به في أي وقت خلال فترة الإيجار، فإن Octane تحتفظ بالحق في تقديرها الخاص بتعطيل المركبة فورًا، واستعادة المركبة من العميل، وإنهاء الاتفاقية دون أي رد للأموال.

b. يقر العميل ويوافق كذلك على أن الإجراءات التي تتخذها Octane كما هو موضح في القسم 7.2 من هذه الاتفاقية ضرورية بسبب زيادة مخاطر الحوادث والمخاطر الأمنية المرتبطة بالقيادة بسرعة عالية. يفهم العميل ويوافق على أن هذا السلوك محظور في الإمارات العربية المتحدة ويشكل مخالفة مرورية خطيرة.

c. يتنازل العميل بشكل نهائي وغير مشروط عن جميع الحقوق والمطالبات والمطالب من أي نوع ضد Octane أو أي من موظفيها فيما يتعلق بالإجراءات التي تتخذها Octane كما هو مذكور في هذا القسم 7.2.

8. Insurance, Restricted Activities

Any vehicle rented from OCTANE is insured with standard third-party insurance for regular reasonable driving on paved roads within the UAE only, therefore, any off-road activity or Restricted Activities shall not be covered by the standard insurance.
Regardless of insurance coverage, the Customer shall fully indemnify OCTANE for any loss, damage, and legal actions, including reasonable attorney’s fees that OCTANE suffers due to Customer’s use of Vehicle during, including but not limited to, damage to the Vehicle, damage to the property of others, injury to Customer, and injury to others. This provision survives the expiration or termination of the T&Cs.

أي مركبة مستأجرة من أوكتان مؤمّنة بتأمين قياسي ضد الغير للاستخدام العادي والمعقول على الطرق المعبّدة داخل دولة الإمارات العربية المتحدة فقط. وبناءً عليه، فإن أي نشاط خارج الطريق أو الأنشطة المحظورة لا تكون مشمولة بالتأمين المقدم من أوكتان
بصرف النظر عن التأمين ، يجب على العميل تعويض أوكتان بالكامل عن أي فقدان أو أضرار أو إجراءات قانونية ، بما في ذلك مدفوعات المحاماة المعقولة التي تحصل عليها أوكتان بسبب استخدام المركبة من قبل العميل خلال فترة الإيجار، بما في ذلك على سبيل المثال لا الحصر، أضرار المركبة ، وأضرار ممتلكات الآخرين وإصابة العميل وإصابة الآخرين. يظل هذا الحكم ساريا بعد انتهاء الشروط والأحكام أو إنهائها.

Restricted Activities

(a) The Restricted Activities are hereby expressly prohibited;

أ‌- الأنشطة المحظورة ممنوعة بموجب هذا صراحة؛

(b) Any other activities and usage of vehicle, including but not limited to driving under the influence of drugs and/or alcohol, pushing, pulling or towing objects, races and fun or adventure drives, rough or off roads & desert safaris, using the car on race track, teaching/learning driving, rent the vehicle to any other person, drifting, parking the vehicle in standing water, towing, etc., (“Restricted Activities”) are expressly prohibited hereby.

2- أي أنشطة واستخدامات أخرى للمركبة، بما في ذلك على سبيل المثال لا الحصر القيادة تحت تأثير المواد المخدرة او المشروبات الكحولية، ودفع الأشياء أو سحبها أو جرها، والسباقات او المتعة أو رحلات المغامرة، والقيادة في الطرق الوعرة والغير معبدة، ورحلات السفاري الصحراوية، واستخدام السيارة في مضمار للسباق, أو في تعليم/تعلم القيادة أو القيام بتأجير المركبة لأي شخص آخر أو التفحيط، ويحظر إيقاف السيارة في المياه الراكدة أو جرها أو ما إلى ذلك (“الأنشطة المحظورة”) ممنوعة صراحة بموجب هذا.

(c) The Customer shall be liable for all damage to the vehicle as a result of any accidents while performing any of the Restricted Activities, and in addition, in such an event, the Customer shall also pay to OCTANE a penalty of AED 2,000.

3- العميل مسؤول عن جميع الأضرار التي تلحق بالمركبة نتيجة لأي حوادث أثناء قيامه بأي من الأنشطة المحظورة، وبالإضافة إلى ذلك، وفي مثل هذه الحالة، يدفع العميل غرامة قدرها 2000 ألف درهم إلى أوكتان.

9. Vehicle Management System, Other conditions of use, General Damage, Octane Shield, Octane Freedom

9.1 Vehicle Management System

9.1 نظام إدارة المركبة

The Vehicle is equipped with a vehicle management system (VMS) that allows for the remote opening and closing of the Vehicle, tracking its location, distance traveled, and speed during the Lease Period. The VMS can also immobilize the Vehicle if there is non-payment, speeding violation or suspected Prohibited Use. By renting and using the Vehicle, the Customer acknowledges all of the above and agrees to have their location and usage tracked by the VMS, which may involve the collection of personal data.

تكون المركبة مجهزة بنظام إدارة المركبة (VMS) الذي يسمح بفتح وإغلاق المركبة عن بُعد، وتتبع موقعها، والمسافة المقطوعة، والسرعة خلال فترة الإيجار. يمكن لنظام إدارة المركبة أيضًا تعطيل المركبة في حال عدم الدفع، أو انتهاك حدود السرعة، أو الاستخدام المحظور المشتبه به. من خلال استئجار واستخدام المركبة، يقر العميل بكل ما سبق ويوافق على تتبع موقعه واستخدامه بواسطة نظام إدارة المركبة، مما قد يتضمن جمع البيانات الشخصية.

9.2 Other conditions of use

9.2 شروط الاستخدام الأخرى

The Customer shall sue the Vehicle with reasonable care and shall not use the Vehicle to:

1) Carry a number of people above the capacity of the Vehicle;
2) Carry or transport a substance or material that may damage the vehicle or cause a smell that may make it undesirable for use by others;
3) Undertake or aid and abet in any illegal or criminal act;
4) Carry passengers for hire as taxi or carpool service in exchange of money;
5) Sub-rent/sub-lease the Vehicle to any other person(s).

يعتني العميل بالمركبة بالشكل المطلوب ولا يستخدم المركبة للغايات التالية:

1) حمل عدد من الأشخاص يتجاوز سعة المركبة؛

2) حمل أو نقل مادة أو مواد قد تلحق ضرراً بالمركبة أو تسبب رائحة تجعلها غير مرغوبة للاستخدام من قبل الآخرين؛

3) استخدام المركبة كوسيلة نقل للركاب مثل خدمة التاكسي أو خدمة مشاركة المركبة مقابل نقود؛

4) الإيجار من الباطن / تأجير المركبة من الباطن لأي شخص (أشخاص) آخرين

9.3 Without prejudice to the provisions of this Agreement accidental damage occurred and the Customer has corresponding green card from police with marked second guilty side, the Customer may not be liable to pay for this damage;

9.3 مع عدم الإخلال بأحكام الاتفاقية، ففي حالة حدوث أي ضرر عرضي، وحصل العميل على بطاقة خضراء من الشرطة مع وجود علامة المذنب هو الطرف الثاني، فقد لا يكون العميل مسؤولاً عن دفع ثمن هذا الضرر؛

9.4 If damage has occurred to the Vehicle and the Customer has a corresponding
red card from the police or a green card without marked second guilty side, the Customer is
liable to pay an additional charge (ranging from AED 1,000 to AED 8,000 depending on the
type of the Vehicle). In such event, if the Customer or one of Customer’s additional drivers
is below 25 years old, the Customer is liable to pay an additional charge of 10% of the
damage repair cost, if the Vehicle is a sport type vehicle, the Customer is liable to pay
another additional charge of 10% of the damage repair cost; In the event the Vehicle is in a
total loss, the Customer undertakes to pay to OCTANE an amount up to 20% of the purchase
price of the vehicle in addition to any other amounts permitted by law;

9.4 في حالة حدوث ضرر للمركبة وحصل العميل على بطاقة حمراء من الشرطة أو البطاقة الخضراء دون وضع علامة المذنب هو الطرف الثاني، يكون العميل مسؤولاً عن دفع رسوم إضافية (تتراوح من 1000 درهم إماراتي إلى 8000 درهم إماراتي تبعاً لنوع المركبة). وفي مثل هذه الحالة، إذا كان عمر العميل أو أحد السائقين الإضافيين للعميل دون سن 25 عامًا، فإن العميل مسؤولاً عن دفع رسوم إضافية بنسبة 10٪ من تكلفة إصلاح الضرر، وإذا كانت المركبة من النوع الرياضي، فإن العميل مسؤولاً عن دفع رسوم إضافية بنسبة 10٪ من تكلفة إصلاح الضرر؛ وفي حالة تعرض المركبة لخسارة كلية، يتعهد العميل بدفع مبلغ يصل الى 20٪ من ثمن شراء المركبة إلى أوكتان بالإضافة إلى أي مبالغ أخرى يسمح بها القانون.

9.5 In case of any damage to the Vehicle, a police report must be obtained by the Customer, otherwise, the Customer will be held accountable for all damage and repair costs;

9.5 في حالة حدوث أي ضرر للمركبة، لا بدّ للعميل من الحصول على تقرير الشرطة، وإلا فإن العميل مسؤولاً عن دفع جميع تكاليف الضرر والإصلاح؛

9.6 It may be noted that any damage to the Vehicle’s windshields, tires, wheels, tools and wheel cap is not included in the standard insurance policy and shall accordingly be borne by the Customer;

9.6 تجدر الإشارة إلى أن أي ضرر يلحق بالزجاج الأمامي للمركبة، والإطارات ، والعجلات ، والأدوات ، وغطاء العجلة غير مشمول في السياسة القياسية للتأمين المقدم من أوكتان وبالتالي يتحمله العميل؛

9.7 OCTANE shall in no event be responsible in any way for any other passengers in the Vehicle in any unfortunate event of any accident;

9.8 To the extent permitted by applicable law, in all cases, OCTANE is entitled to any and all compensation or monies paid in connection with damages to OCTANE Vehicle. In the event the Customer receives any such monies, the Customer agrees to hold such monies in trust on behalf of OCTANE and agrees to promptly make payment of such monies to OCTANE.

9.8 بالقدر الذي يسمح به القانون المعمول به، يحق لأوكتان في جميع الحالات الحصول على أي وجميع التعويضات أو الأموال المدفوعة فيما يتعلق بالأضرار التي لحقت بمركبة أوكتان. وفي حالة استلام العميل لأي من هذه الأموال، فيوافق العميل على الاحتفاظ بهذه الأموال كأمانة ونيابة عن أوكتان ويوافق على دفع هذه الأموال فوراً إلى أوكتان.

9.9 If the Vehicle is involved in an accident and the police report does not confirm that the accident was not caused by the Customer’s fault, the Customer shall pay the then-current OCTANE’s 30 plus daily rental rate for each day the vehicle is out of service for repairs.

9.9 إن وقعت المركبة في الحادث ولم يؤكد تقرير الشرطة براءة العميل، يجب على العميل دفع الرسوم اليومية للتغيرات الأخيرة لمدة 30 يوما لكل يوم تكون المركبة خارج الخدمة بسبب الإصلاح.

9.10 Octane Shield

a. The Customer may purchase the additional protection, the Octane Shield to waive or further reduce the Customer’s already limited liability under the standard insurance policy, provided the Vehicle is used in accordance with the Agreement.

b. Subject to the terms and conditions of the Agreement, by purchasing the Octane Shield , the Customer is not required to pay the following custom excess liability amounts under the terms of the standard insurance policy for all incidents during the Lease Term caused by accidental damage to the Vehicle.

1)The standard excess liability amount.
2)The excess liability amount for a Vehicle that is a sports car.
3)The excess liability amount if the driver is less than 25 years old.

c. Subject to the Customer providing a valid Police Report, the Octane Shield will apply to any loss of or damage to the Vehicle, its parts, and accessories (unless caused by theft), including the following damages:

1)Tires and rims.
2)Windows and front and back glasses.
3)Side mirrors
4)Interior damage up to AED 1,000 (*does not apply to any damage caused by smoking or in case of soiling).
5)Loss of keys.
6)Cost of a tow truck in case of an accident.

d. The Octane Shield does not apply to the following damages, losses, and circumstances:

1)In case of a total loss to the Vehicle.
2)In case of theft of the Vehicle.
3)If the Customer fails to present a valid Police Report (*not required for damage to tires/rims, or interior damage up to AED 1,000).
4)If the insurance company denies an insurance claim made by the Customer.
5)If the driver involved is not the Customer or an authorized by OCTANE additional driver.
6)If the Customer (or any authorized by OCTANE additional driver) breaches this T&C and/or Agreement.
7)If the damage was caused intentionally.
8)If the Vehicle was used in any of the Restricted Activities or Restricted Use.
9)In case of putting the wrong fuel in the vehicle or otherwise contaminating the fuel.
10)If a third party sues OCTANE because of the Customer’s actions or defaults.

e. The Octane Shield Amount Limitation. Not insurance.
For the avoidance of doubt, the Octane Shield is not an insurance, but rather a contractual obligation to pay for the Customer the payments in clauses 9.10 (b) and 9.10 (c) above subject to the rest terms of the Agreement.

f. The Octane Shield Priority.
If the Customer is covered by another product for the same benefits as those listed here, including but not limited to any credit card travel or personal auto insurance, the Customer must first use such other product. The Octane Shield will be provided for the outstanding amount (if any) after the claim for other product(s) is completed.

g. The Octane Shield Tariffs
The Octane Shield Payment is according to the drivers age, cost and type of the Vehicle rented as indicated in the Agreement, and consists of the Octane Shield Base Fee together with the Octane Shield Extra Fee for each additional rental day beyond 1 (one) day, including any prolongation of the Lease Period.

9.10 درع أوكتين

a. يمكن للعميل شراء الحماية الإضافية، درع أوكتين، للتخلص من أو تقليل المسؤولية المحدودة التي يتحملها العميل بالفعل بموجب السياسة القياسية للتأمين، شريطة أن يتم استخدام المركبة وفقًا لاتفاقية التأجير.

b. بناءً على شروط وأحكام الاتفاقية، من خلال شراء درع أوكتين، فإن العميل غير مطالب بدفع المبالغ الإضافية المخصصة التالية بموجب السياسة القياسية للتأمين لجميع الحوادث خلال فترة الإيجار الناتجة عن الأضرار العرضية للمركبة:

1) المبلغ القياسي للمسؤولية الزائدة

2) المبلغ الزائد للمسؤولية لسيارة رياضية.

3) المبلغ الزائد للمسؤولية إذا كان السائق أقل من 25 سنة.

c. بشرط تقديم العميل تقرير شرطة صالح، سينطبق درع أوكتين على أي فقدان أو ضرر للمركبة، وقطع غيارها، وملحقاتها (ما لم يكن السبب في ذلك السرقة)، بما في ذلك الأضرار التالية:

1)الإطارات وغطاء العجلة.

2)الزجاج الأمامي والخلفي.

3)المرايا الجانبية.

4)الأضرار الداخلية حتى 1000 درهم (لا ينطبق على الأضرار الناجمة عن التدخين أو التلوث).

5)فقدان المفاتيح.

6)تكلفة سيارة القطر (الريكوفري)

d. لا ينطبق درع أوكتين على الأضرار، والخسائر، والظروف التالية

1)في حالة فقدان كامل للمركبة.

2)في حالة سرقة المركبة.

3)إذا فشل العميل في تقديم تقرير شرطة صالح (غير مطلوب للأضرار للإطارات/الحافات، أو الأضرار الداخلية حتى 1000 درهم).

4)إذا رفضت شركة التأمين مطالبة تأمينية قدمها العميل.

5)إذا كان السائق المعني ليس العميل أو سائق إضافي مصرح به من قبل أوكتين.

6)إذا خرق العميل (أو أي سائق إضافي مصرح به من قبل أوكتين) هذه الشروط و/أو الاتفاقية.

7)إذا تسببت الأضرار بشكل متعمد.

8)إذا تم استخدام المركبة في أي من الأنشطة المحظورة أو الاستخدام المقيد.

9)في حالة وضع الوقود الخاطئ في المركبة أو تلويث الوقود بأي شكل من الأشكال.

10)إذا قام طرف ثالث بمقاضاة أوكتين بسبب أفعال أو تقصير العميل.

e. حدود مبلغ درع أوكتين. ليس تأمينًا
لتجنب الشك، فإن درع أوكتين ليس تأمينًا، ولكنه التزامًا عقديًا بدفع المبالغ للعميل المذكورة في الفقرتين 9.10 (b) و 9.10 (c) أعلاه بشرط بقية أحكام الاتفاقية.

f. أولوية درع أوكتين.
إذا كان العميل مغطى بمنتج آخر يوفر نفس المزايا المذكورة هنا، بما في ذلك ولكن لا يقتصر على أي تأمين سفر ببطاقة الائتمان أو تأمين السيارات الشخصي، يجب على العميل استخدام هذا المنتج الآخر أولاً. سيتم توفير درع أوكتين للمبلغ المتبقي (إن وجد) بعد اكتمال المطالبة للمنتج(ات) الآخرى.

g. تعريفات درع أوكتين.
يتم احتساب دفعة درع أوكتين وفقًا لعمر السائق وتكلفة ونوع المركبة المستأجرة كما هو مبين في هذا الاتفاق، وتتكون من الرسوم الأساسية لـ درع أوكتين مضافًا إليها الرسوم الإضافية لـ درع أوكتين عن كل يوم إيجار إضافي بعد اليوم الواحد (1)، بما في ذلك أي تمديد لمدة فترة الإيجار .

9.11 Octane Freedom parking and toll roads

a. The Customer has the option to purchase additional parking and toll roads coverage for the rented Vehicle, referred to as “Octane Freedom”. Provided the Customer uses the Vehicle in accordance with the Agreement and subject to all terms and conditions therein, the Customer will not be required to pay the following charges during the Lease Period:

1)Salik fees as detailed in clause 6.4 of this Agreement; and.
2)Parking fees for parking at authorised government city parking areas and at parking zones of the Park-in system (https://www.parkin.ae/).

b. For the avoidance of doubt, Octane Freedom applies only to the parking fees expressly specified in Clause 9.11(a)(2) of this Agreement and does not cover any other parking and/or parking related charges, including but not limited to fees for commercial parking facilities and valet services.

c. Parking coverage under Octane Freedom is conditional upon the Customer sending clear photos of the Vehicle’s license plate and the relevant parking sign, together with the required parking duration (in hours), to +971 58 937 6930 at the time of parking. Failure to provide such information shall result in any parking fines incurred being fully charged to the Customer.
The minimum non-refundable fee for the Octane Freedom is AED 119, covering Lease Periods of one (1) day. For any Lease Period exceeding one (1) day, including any prolongation, an additional fee of AED 35 shall apply for each day beyond the initial one (1) day.

9.11 وكتين فريدوم للطرق والمواقف المدفوعة

a. أ. لدى العميل خيار شراء تغطية إضافية للطرق والمواقف المدفوعة للمركبة المؤجرة، يُشار إليها بـ “أوكتين فريدوم”. بشرط أن يستخدم العميل المركبة وفقًا للاتفاقية ومع مراعاة جميع الشروط والأحكام الواردة فيها، لن يُطلب من العميل دفع الرسوم التالية خلال فترة الإيجار:

1)رسوم سالك كما هو موضح في البند 6.4 من هذه الاتفاقية؛ و

2). رسوم المواقف للمواقف في المناطق الحكومية المعتمدة داخل المدينة وفي مناطق نظام Park-in (https://www.parkin.ae/).

b. ب. للتوضيح، ينطبق “أوكتين فريدوم” فقط على رسوم المواقف المحددة صراحةً في البند 9.11(أ) (2) من هذه الاتفاقية ولا يشمل أي رسوم أخرى تتعلق بالمواقف أو ذات صلة بها، بما في ذلك على سبيل المثال لا الحصر الرسوم الخاصة بالمواقف التجارية وخدمات صف السيارات.

c. ج. تكون تغطية مواقف السيارات ضمن برنامج أوكتين فريدوم مشروطة بقيام العميل بإرسال صور واضحة للوحة ترخيص المركبة ولوحة تعليمات الموقف المعني، مع تحديد مدة الوقوف المطلوبة (بالساعات)، إلى الرقم 971589376930+ في وقت الوقوف. وفي حال عدم تزويد هذه المعلومات، يتحمل العميل كامل قيمة أي مخالفات مواقف يتم تسجيلها.
الحد الأدنى للرسوم غير القابلة للاسترداد لخدمة أوكتين فريدوم هو 119 درهمًا إماراتيًا، ويغطي فترات إيجار مدتها يوم واحد (1). وفي حال تجاوزت فترة الإيجار يومًا واحدًا (1)، بما في ذلك أي تمديد، تُفرض رسوم إضافية قدرها 35 درهمًا إماراتيًا عن كل يوم يتجاوز اليوم الأول (1).

10. Other conditions of use

10- شروط الاستخدام الأخرى

10.1 The Customer shall sue the Vehicle with reasonable care and shall not use the Vehicle to:

10.1- عتني العميل بالمركبة بالشكل المطلوب ولا يستخدم المركبة للغايات التالية

10.2 carry a number of people above the capacity of the Vehicle;

10.2- إركاب عددًا من الأشخاص فوق سعة تحمل المركبة؛

10.3 carry or transport a substance or material that may damage the vehicle or cause a smell that may make it undesirable for use by others;

10.3- مل أو نقل مادة او أدوات قد تلحق الضرر بالمركبة أو تسبب رائحة تفضي إلى عدم الرغبة في استخدامها من قبل الآخرين؛

10.4 undertake or aid and abet in any illegal or criminal act;

10.4- لتعهد أو المساعدة أو التحريض على أي عمل غير قانوني أو إجرامي؛

10.5 carry passengers for hire as taxi or carpool service in exchange of money;

10.5- ستخدام المركبة كوسيلة نقل للركاب مثل خدمة التاكسي أو خدمة مشاركة المركبة مقابل نقود؛

10.6 sub-rent/sub-lease the Vehicle to any other person(s).

10.6- لإيجار من الباطن / تأجير المركبة من الباطن لأي شخص (أشخاص) آخرين.

11. Parking and impounding of Vehicle and loss of keys

11- قوف السيارات وحجزها وفقدان المفاتيح

11.1 The Customer is to make sure that the Vehicle is always parked in a safe and secure location and that all doors are kept always locked when the Vehicle is unattended. OCTANE shall in no event be held accountable for any loss or theft of goods belonging to the Customer or any other person from the Vehicle. The responsibility of safekeeping of any of the Customer’s or any other person’s using the Vehicle shall at all times remain on the Customer.

11.1- يجب على العميل التأكد من أن المركبة مصفوفة دائما في مكان آمن وأن جميع الأبواب مغلقة دائمًا في حال كانت المركبة غير مستعملة أو غير مراقبة. ولا تتحمل أوكتان، بأي حال من الأحوال، المسؤولية عن أي خسارة أو سرقة للممتلكات للعميل أو أي شخص آخر من المركبة. تقع مسؤولية حفظ المركبة سواء استخدمت من العميل أو من قبل أي شخص آخر على عاتق العميل في جميع الأوقات.

11.2 The Customer will be responsible for the loss of any keys and in such event will be liable to a minimum charge of AED 1,500, subject to the type of the Vehicle.

11.2- تحمل العميل مسؤولية فقدان أي مفاتيح، وفي هذه الحالة يكون مسؤولاً عن دفع رسم بحد أدناه 1500 درهم إماراتي، تبعاً لنوع السيارة.

11.3 The Customer will be liable to pay OCTANE for all the impounding charges, damages and loss of any rental charges/income in the event of the Vehicle being impounded by authorities.

11.3- تحمل العميل مسؤولية الدفع لأوكتان عن جميع رسوم الحجز، والأضرار، وخسارة أي رسوم / دخل إيجار وذلك في حالة احتجاز السلطات للمركبة.

12. Smoking and interior cleaning

12- لتدخين والتنظيف الداخلي

12.1 Smoking Restrictions:

a. Smoking is strictly prohibited inside the vehicle at all times.

b. A penalty of AED 500 will be charged for any instances of smoking inside the vehicle.

12.1 قيود التدخين:

a. يُمنع التدخين تمامًا داخل السيارة في جميع الأوقات.

b. بسيتم فرض غرامة قدرها 500 درهم إماراتي في حال التدخين داخل السيارة.

12.2 Cleanliness Standards:

a. Vehicles must be returned in a reasonably clean condition.

b. A cleaning fee of AED 50 + VAT will be applied if the vehicle is returned dusty or inadequately cleaned.

c. If the vehicle is returned in an excessively unclean state, a cleaning fee of AED 500 will be charged.

12.2 معايير النظافة:

a. يجب إعادة السيارة بحالة نظيفة بشكل معقول.

b. سيتم تطبيق رسوم تنظيف قدرها 50 درهمًا إماراتيًا إذا تم إعادة السيارة مغبرة أو غير نظيفة بشكل كافٍ.

c. إذا تم إعادة السيارة بحالة غير نظيفة بشكل مفرط، سيتم فرض رسوم تنظيف قدرها 500 درهم إماراتي.

13. Vehicle refueling

13- زويد المركبة بالوقود

All vehicles are supplied with a full tank of fuel and should be refilled before return to OCTANE, otherwise, a charge of AED 6.5 per liter for any missing fuel will be charged in addition to any other charges as may be applicable to the Customer in accordance with the Agreement. For clarity, no refunds will be given for any unused fuel.

تم تزويد جميع المركبات بخزان كامل من الوقود، ويجب إعادة تعبئته قبل إعادته إلى أوكتان، وإلا سيتم فرض رسوم قدرها 6.5 دراهم إماراتية لكل لترعن أي وقود مفقود، بالإضافة إلى أي رسوم أخرى قد تنطبق على العميل وفقًا للاتفاقية. للتوضيح، لن يتم رد المبالغ المدفوعة لأي وقود غير مستخدم.

14. Wi-Fi router

14. تزويد المركبة بالوقود

14.1 The Customer may rent the Wi-Fi router with a SIM card for the lease period at rate of AED 29 per day for the purpose of accessing the Internet. The SIM card is for data use only. Voice calls, SMS, and any device modification are prohibited.

14.1 يجوز للعميل استئجار جهاز راوتر Wi-Fi مع بطاقة SIM طوال فترة الإيجار مقابل 29 درهمًا إماراتيًا في اليوم لغرض الوصول إلى الإنترنت. وتُستخدم بطاقة الـSIM للبيانات فقط، كما يُحظر إجراء المكالمات الصوتية أو إرسال الرسائل النصية أو إجراء أي تعديل على الجهاز.

14.2 Internet access via company Wi-Fi router must not be used for unlawful activity under UAE law. The Customer accepts sole liability for all use during the rental period.

14.2 يجب عدم استخدام خدمة الإنترنت من خلال راوتر الشركة في أي نشاط غير قانوني وفقًا لقوانين دولة الإمارات العربية المتحدة. ويتحمل العميل وحده المسؤولية الكاملة عن جميع الاستخدامات خلال فترة الإيجار.

14.3 Assignment of the Wi-Fi router and SIM is recorded in this Agreement and may be disclosed to UAE authorities if necessary. The Customer agrees to cooperate fully with Octane and UAE authorities in case of any investigation related to internet usage during the rental period.

14.3 يتم توثيق تسليم جهاز الـWi-Fi وبطاقة الـSIM في هذا العقد، وقد يتم الإفصاح عن هذه المعلومات للجهات المختصة في دولة الإمارات عند الضرورة. ويوافق العميل على التعاون الكامل مع شركة أوكتان والسلطات الإماراتية في حال إجراء أي تحقيق متعلق باستخدام الإنترنت خلال فترة الإيجار.

14.4 The Customer indemnifies and holds Octane harmless from any claims, penalties, or fines arising from misuse of the Wi-Fi device, including violations under Federal Decree-Law No. 34 of 2021 on Combatting Rumors and Cybercrimes.

14.4 يعوِّض العميل شركة أوكتان ويحميها من أي مطالبات أو غرامات أو عقوبات ناتجة عن سوء استخدام جهاز الـWi-Fi، بما في ذلك المخالفات المنصوص عليها في المرسوم بقانون اتحادي رقم 34 لسنة 2021 بشأن مكافحة الشائعات والجرائم الإلكترونية.

14.5 In the event the Wi-Fi router is not returned, the Customer shall be liable for a penalty fee of AED 1,000.

14.5 في حال عدم إعادة جهاز الراوتر، يكون العميل مسؤولًا عن دفع غرامة قدرها 1,000 درهم إماراتي.

15. General Provisions

15- حكام عامة

15.1 Term of Agreement The Agreement between the Customer and OCTANE shall be valid from the date it has been signed by the Customer and shall, without prejudice to any liability of the Customer pursuant to the Agreement, expire upon return of the Vehicle as confirmed by the OCTANE’s representative. Any expiry of this Agreement shall be without prejudice to OCTANE’s rights to enforce any of its rights against the Customer.

15.1- مدة الاتفاقية. تكون الاتفاقية بين العميل واوكتان سارية المفعول من تاريخ توقيعها من قبل العميل، وتنتهي عند إعادة المركبة على النحو الذي يؤكده ممثل اوكتان، وذلك دون المساس بأي مسؤولية تقع على عاتق العميل بموجب الاتفاقية. ولا يخل أي انتهاء لهذه الاتفاقية بحقوق اوكتان في إنفاذ أي من حقوقها ضد العميل.

15.2 Entire Agreement. This Agreement, together with any other documents incorporated herein by reference (including the T&Cs) and all related exhibits, constitutes the sole and entire agreement of between the parties hereto with respect to the subject matter of this Agreement and supersedes all prior and contemporaneous understandings, agreements, and representations and warranties, both written and oral, with respect to such subject matter.

15.2- الاتفاقية بأكملها. تشكل هذه الاتفاقية ، جنبًا إلى جنب مع أي مستندات أخرى مدرجة هنا بالإشارة (بما في ذلك الشروط والأحكام) وجميع المستندات ذات الصلة، الاتفاقية الوحيدة والكاملة بين الأطراف بموجب هذه الاتفاقية فيما يتعلق بموضوع هذه الاتفاقية، وتحل محل جميع التفاهمات السابقة والمعاصرة، والاتفاقات والإقرارات والضمانات، المكتوبة والشفوية، فيما يتعلق بهذا الموضوع.

14.3 Amendment and Modification; Waiver. No amendment to or modification of this Agreement is effective unless it is in writing and signed by an authorized representative of each of the parties. No waiver by any party of any of the provisions hereof will be effective unless explicitly set forth in writing and signed by the party so waiving. Except as otherwise set forth in this Agreement, (i) no failure to exercise, or delay in exercising, any rights, remedy, power, or privilege arising from this Agreement will operate or be construed as a waiver thereof.

14.3- التعديل والتغيير؛ التنازل. لا يعتبر أي تعديل أو تغيير لهذه الاتفاقية ساري المفعول ما لم يكن مكتوبًا وموقعًا من قبل ممثل مفوض لكل طرف من الأطراف. لن يكون أي تنازل من قبل أي طرف عن أي من الأحكام المنصوص عليها في هذه الاتفاقية ساريًا ما لم ينص على ذلك صراحةً كتابةً وموقعًا من قبل الطرف المتنازل عن ذلك. وباستثناء ما هو منصوص عليه في هذه الاتفاقية، (1) عدم الإخفاق في ممارسة، أو التأخير في ممارسة، أي حقوق أو تعويض أو سلطة أو امتياز ناشئ عن هذه الاتفاقية سيعمل أو يفسر على أنه تنازل عنها.

15.4 Severability If any provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

15.4- قابلية الفصل. إذا كان أي حكم من أحكام هذه الاتفاقية باطلاً أو غير قانوني أو غير قابل للتنفيذ في أي ولاية قضائية، فلن يؤثر البطلان أو عدم الشرعية أو عدم قابلية التنفيذ على أي بند أو حكم آخر من هذه الاتفاقية أو يبطل أو يجعل هذا المصطلح أو الحكم غير قابل للتنفيذ في أي ولاية قضائية أخرى.

15.5 Assignment. Neither Party may assign any of its rights or delegate any of its obligations hereunder, in each case whether voluntarily, involuntarily, by operation of law or otherwise, without the prior written consent of OCTANE.

15.5- الإحالة. يجوز لأي من الطرفين التنازل عن أي من حقوقه أو تفويض أي من التزاماته بموجب هذه الاتفاقية، سواء أكان ذلك طوعًا أو كرهاً أو بموجب القانون أو غير ذلك، دون موافقة خطية مسبقة لأوكتان.

15.6 Source of Funds Declaration. The Customer warrants and confirms hereby that the source of funds for any payments under this Agreement are not derived from, or related to, any activity that is illegal or illegitimate or deemed criminal under the laws of the UAE.

15.6- إعلان مصدر الأموال يضمن العميل ويؤكد بموجب هذا أن مصدر الأموال لأي مدفوعات بموجب هذه الاتفاقية ليس مشتقًا من أو متعلقًا بأي نشاط يُعتبر غير قانوني أو غير شرعي أو يُعتبر جنائيًا بموجب قوانين الإمارات العربية المتحدة.

16. Limitation of OCTANE’s Liability

15- تحديد مسؤوليةأوكتان

Notwithstanding anything to the contrary expressed or implied in this Agreement, OCTANE (including its affiliates, mother company, subsidiaries, associated companies, successors, and assigns and each of their respective officers, directors, agents, and employees severally and collectively)shall not be liable to the Customer for any general, indirect, or consequential damages or any economic losses of any kind, regardless of whether the liability to which such damages relate arises in contract, tort, or otherwise in law, for any injury, loss, or damage sustained by the Customer (including its affiliates, subsidiaries, associated companies, successors, and assigns and each of their respective officers, directors, agents, and employees) arising from this Agreement or the Customer’s use of OCTANE Vehicle.

بصرف النظر عن أي شيء مخالف لذلك صريحًا أو ضمنيًا في هذه الاتفاقية، لن تكون أوكتان مسؤولة تجاه العميل عن أي أضرار عامة أو غير مباشرة أو تبعية أو أي خسائر اقتصادية من أي نوع ، وبغض النظر عما إذا كانت المسؤولية التي تتعلق بهذه الأضرار تنشأ في العقد، أو غير ذلك بموجب القانون ، لن تكون شركة أوكتان مسؤولة عن أي إصابة أو خسارة أو ضرر يتكبده العميل (بما في ذلك الشركات التابعة لها والفروع التابعة لها والشركات المرتبطة بها وممثلي المكاتب والمتنازل لهم وكل من مسؤوليهم ومديريهم ووكلائهم وموظفيهم ) الناشئة عن هذه الاتفاقية أو استخدام العميل لمركبة شركة أوكتان.

17. Indemnity

16- التعويض

The Customer shall indemnify and hold harmless OCTANE (including its affiliates, mother company, subsidiaries, associated companies, successors, and assigns and each of their respective officers, directors, agents, and employees severally and collectively) from any and all losses, claims, demands, liabilities, damages, pleadings, fines, penalties, judgments, and expenses (including, without limitation, legal expenses on a lawyer and his own client basis), suffered or incurred by or brought against any or all of them, including by third parties, by reason of any act or omission of OCTANE or its officers, directors, agents, employees, or subcontractors in relation to this Agreement or the Customer’s use of OCTANE Vehicles.

جب على العميل تعويض شركة اوكتان وإبعاد الضرر عنها (بما في ذلك الشركات التابعة لها والشركة الأم والشركات التابعة لها والشركات المرتبطة بها وخلفائها ومكاتبها الممثلة وكل من مسؤوليهم ومديريهم ووكلائهم وموظفيهم بشكل فردي وجماعي) من أي وجميع الخسائر والمطالبات ، المطالب ، والالتزامات ، والأضرار ، والمرافعات ، والغرامات ، والعقوبات ، والأحكام ، والنفقات (بما في ذلك ، على سبيل المثال لا الحصر ، النفقات القانونية على المحامي وأساس موكله) ، التي تكبدها أو تكبدها أو تم رفعها ضد أي منهم أو جميعهم ، بما في ذلك من قبل طرف ثالث ، بسبب أي فعل أو إغفال من جانب شركة اوكتان أو مسؤوليها أو مديريها أو وكلائها أو موظفيها أو مقاوليها من الباطن فيما يتعلق بهذه الاتفاقية أو استخدام العميل لمركبات شركة اوكتان .

18. Governing Law & Submission to Jurisdiction

18- القانون الواجب التطبيق والخضوع للاختصاص القضائي

This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any claim, dispute or controversy arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent courts of the Emirate of Dubai.

خضع هذه الاتفاقية لقوانين دولة الإمارات العربية المتحدة المطبقة في إمارة دبي ويفسر وفقاً لها، وتحال أي مطالبة أو نزاع أو خلاف ينشأ عن أو فيما يتعلق بهذه الاتفاقية إلى الاختصاص القضائي الحصري للمحاكم المختصة في إمارة دبي.
